Terms and Conditions of Sale

Payments:
• A deposit of 25% of the course fee is payable upon booking the course, the booking is not confirmed until the deposit is paid.
• The final 75% of the fee must be paid 30 days before the course is due to commence. The full amount of the course is payable if the booking is made within 30 days of the date of commencement of the course. If the final payment is not received by the due date, the booking will deemed to have been cancelled.
• If the student wishes to change the dates of the course within 30 days of the date of commencement, Spirit Sailing will make all efforts to accommodate the request. If this is not possible then Spirit Sailing will not be liable for the return of the deposit.
• Payments and deposits be only be refunded if written confirmation of cancellation is received within 60 days of the date of commencement of the course.

 

Age Limits:
• Spirit Sailing cannot accept students under the age of 16 unless accompanied by a parent or appointed guardian.
• Students between 16-18 yrs of age will require written authority of a parent or appointed guardian.
• There is no upper age limit, but students should satisfy themselves that they are fit to complete the course.

Insurance:
• Our yachts are fully insured against accidents and third party liability, but responsibility is not accepted for personal accidents, damage or loss caused by your negligence. Unnecessary damage or loss cased by your carelessness will be paid for by you at replacement cost - fair wear and tear accounted for. You are strongly advised to arrange personal insurance cover for your won cancellation, bodily injury and personal liability.

Students responsibilities:
Students have the following responsibilities
• To ensure that they do not take any action that jeopardises the safety of fellow clients, skippers or boats.
• To observe the rules of Customs and Excise, and any other authorities to which they become subject.
• To observe the standards of personal conduct which will not be considered offensive by fellow crew members or neighbouring vessels.
• In the event of unacceptable behaviour, Spirit Sailing reserves the right to terminate the offending clients course. Under such circumstances fees will not be refundable.
• To inform the school of any known medical condition relevant to the students fitness to complete the course.

RYA Certificates:
Spirit Sailing has high standards of instruction and applies RYA guidelines on the issue of certificates. Certificates will only be issued if, in the opinion of the instructor, the student has reached the necessary standard.

Health:
• Sailing is an activity sport and it is the responsibility of the student to ensure that they are fit and healthy to sail. Please check with your doctor if you have any doubts about you eligibility to partake in such an

activity. If, for whatever reason, the skipper has to put a student ashore, or administer medical aid, Spirit Sailing or its representatives accept no responsibility or liability.

Late Arrivals:
• Spirit Sailing will make every effort to revise sailing schedules to accommodate late arrivals, however if such delays affect other student's courses, the skipper may sail without the delayed student. In such cases no refund shall be given.
